ADJUDICATION

Adjudication is a "fast track" binding interim method of dispute resolution introduced by section 108 of the Housing Grants, Construction and Regeneration Act 1996 for all construction contracts (as defined in that Act) entered into on or after 1 May 1998. The Branch is an Adjudicator Nominating Body for the purposes of The Scheme for Construction Contracts (Scotland) and many of our members are regularly involved in adjudications. For these reasons this Adjudication section of our web site is in two distinct parts:

Adjudication Resources - All of the legislation and statutory instruments which govern or affect the process of adjudication under the Housing Grants, Construction and Regeneration Act 1996 are freely available on the web. It is also possible to find court cases relating to adjudication, and commentaries on those cases, on the web. However, unless you are a lawyer or a claims consultant specialising in construction dispute resolution with cause to refer to these items daily they can often be difficult to locate easily. For that reason we have gathered together links to all of the key resources on the web in one simple, easy to use page. We hope you will find it helpful and that it might make the running of adjudications in Scotland a little easier for all concerned.
